General Terms and Conditions of the Agreement

These general provisions of this Agreement regulate the use of all the services that the service supplier offers to the Internet users.
 
Simply by using this Web site, the visitor becomes an end-user and expresses his unqualified acceptance of the general terms and conditions of this agreement, as well as being bound by all special provisions, notices and instruction regulations relating to specific contents and services, by completing the terms and conditions covered by the general terms of this agreement, in as much as they do not contradict them.
 
The end-user of the service supplier must read carefully the former and the latter, before accessing and using any of the services on the web site, entirely under his /her responsibility. These general provisions may be revised or amended periodically, without prior notification.

Offers and provision of service

The service supplier offers digital image formatting and printing services, as well as image editing for top finishing and presentation.

On the Website the service supplier offers a wide range of digital image formatting and printing services. The end-user may choose among the different formatting and medium possibilities, for one or more photographs he/she must previously submit through the web site.

The amount charged for a digital formatting service by the end-user is the payment for formatting the image(s) submitted through the website, and the printing in the medium(s) of his/her choice. It does not give the end-user the right to receive the formatted image in electronic copy, but only to receive it printed, as mentioned before, on the chosen medium.

The service supplier will choose the best way to perform the service and fulfil the order in the most appropriate manner.

The service supplier may propose new contents, services and additional features to the end-user, with a charge or gratuitously.

Territory for the provision of services

The service supplier offer there services all over of Europe.

Communication with the end-user: the service supplier may contact the end-users who have ordered a service, to follow up the order.

As a general rule, the service supplier will only deliver provided information to users that have requested it. Nevertheless, the service supplier may send information notices through electronic mail, about his services and contents, it may contain advertising. By using the services, the end-users expressly agree to receive advertising content in the communications from the service supplier.

Payment Method

The service supplier offers several payment methods: by credit card, Paypal, or by bank transfer to the indicated account.

As it is an individual and personalized product, the payment must be received in advance, and no changes, refunds or returns are admitted.

Shipping and delivery

The delivery time will depend on the type of product, usually between 5 and 10 days. Deliveries to the Balearic Islands and the Canaries take longer.

The delivery times are approximate, based on our experience with the delivery service. Nevertheless, the service supplier is not committed to these delivery terms, and is not liable for any delays or early deliveries.

There will be no deliveries on Saturdays, Sundays or bankholidays.

The service supplier will select the delivery method in order to deliver the product in the best possible terms. This applies regardless of the kind of shipping, even when the service supplier is covering the shipping expenses. The end-user is subject to checking the content of the delivery upon receipt, and notify the service supplier immediately of any claims or complaints.

Intellectual property entitlements

The end-users is responsible for the content of the images that he submits, and guarantees that he/she is solely entitled to all the rights that may exist on the image he /she submits. The end-user guarantees that he is not infringing the entitlements of third parties on the persons and/or objects in the photo(s), and assumes all the liabilities arising from the infringements on entitlements of intellectual property of third parties, and is hereby obliged to supply at first request a written disclaimer for the service supplier from any liabilities, claims and damages that may arise for which the end-user is responsible.

The end-user retains his/her rights and liabilities on all the data and documents he submitted to the service supplier. Nevertheless, in the context of the ordered service, the service supplier is entitled to modify the submitted data and documents to perform the ordered service.

Illegal or irregular use of the services

The end-user commits to use the web site, the various sections, services and contents in accordance to the law, moral practices, and public order regulations. The end-user will refrain from any illegal use, or any use in contradiction of the general provisions or otherwise unlawful use in such a manner that it may damage or disable them, or that it infringes upon the rights to beliefs and dignity of people.

In any case, accessing the website and the use of the information therein is exclusively the responsibility of the end-user. The service supplier does not keep control, and is under no obligation to keep control over the use of the website, and therefore is not liable for any consequence, damage or liability of any kind, that may arise from the irregular, inadequate and inappropriate use that the end-user may make of the website or the services.

The service supplier reserves the right to suspend the service and/ or the right to refuse access at any given time and without prior notification, if the conduct of the end-user contradicts or does not comply with the applicable terms of use. Once the service has been suspended, the service supplier will keep the stored information during 5 days. Once this term has elapsed the data will be blocked and deleted, without incurring in any liability for this action.

Other general terms and conditions of the license agreement

The end-user expressly accepts to release the service supplier from all liabilities relating to the quality, accuracy, reliability, accuracy of the data, programs and information or opinions expressed, from whatever source, and expressly disclaims any responsibility of the service supplier for the content of any linked websites. The service supplier has no influence on the content of the linked websites, and does not approve or endorse their content.

To improve the effectiveness of the services of the service supplier, the end-user commits to submit updated information, fill in the application forms properly with exact and correct data, and duly notify any changes to the data. If the end-user does not comply with this, the service supplier cannot guarantee the delivery of the service offered through his website.

The end-user expressly acknowledges the entitlement of the service supplier on any copyrights, intellectual and industrial property rights on the use of trademarks, commercial brand names and distinctive logos of the website with all the services and contents of the service supplier. The end-user commits to using such data only for his own needs and not to carry out or suggest any activities banned by law, or not to carry out or suggest, directly or indirectly, to carry out any commercial exploitation of the services and contents he/she can access, or of the results achieved thanks to the use of the website of the service supplier.

It is strictly forbidden to reproduce, distribute, broadcast, adapt or modify by any means, on any medium or form, the contents and other elements of this website, or use the content for any commercial or advertising purpose, regardless of the means, medium or form used, except by previous authorization in writing from its legitimate title holders, or when permitted by law.

The website is regularly updated, nevertheless, it is possible that some data is not current despite careful revisions. The service supplier is not liable for any inaccuracy in the information presented in these pages, he cannot guarantee that there are no errors on accessing the web site, and its content, or that all the information is updated, although he will do his best to avoid the errors, correct them and update the data.

It is strictly forbidden to use, communicate, distribute or publish by any means or on any medium, the direct links or links to any of the sections of the web site, without a prior written authorization issued by the service supplier.
The service supplier is not liable for the possible security errors that may occur, nor is he liable for the damages to the hardware and/or software, the files or documents stored in the hard disk, caused by the presence of a virus, a malfunction of the internet browser software or by the use of outdated software versions. The service supplier is in no case liable for the malfunctioning of the service, or any damage the end-user may suffer because of a failure in the performance of the service and/or the contents.

Should any dispute arise from the interpretation or compliance of the general terms and provisions of this agreement, it will be resolved by arbitration, through the ‘Consumer Arbitration System’ (Sistema Arbitral de Consumo). The service supplier and the end-user hereby agree to be bound by and diligently comply with the arbitral award.
